DESCRIPTION OF THE CONTEST: “Art Your Food”, the second edition of the International Migration Art Festival (IMAFestival), invites participating artists to submit works on the theme of “Food and Migration” in four art categories: Film, Literature, Visual Arts and Music.
Artists that want to participate have to take into consideration that the winners will be awarded during the event held in Milan, at the Museo Nazionale della Scienza e della Tecnologia, May the 5th 2012 and if their works will be selected to be showcased in such final event, shipping and travel expenses are to be paid by the artists themselves.
The finalists in each category will be those who submit the most creative and inspiring works on the theme proposed. The selected finalists will showcase their works during an event held in Milan.
At the closing ceremony of Milan event a jury of highly professional individuals will choose a winner in each category and the public vote will indicate the Audience Award winner. Each winner will be determined by the judges in their sole discretion, and in accordance with these Official Rules.
Eligibility. The Contest is open only to individuals who submit original works that they have personally created to the IMAFestival website as described below (art.5 How to Enter). At the time of entry each entrant must be the legal age of majority in their country, province or state of legal residence. Persons in any of the following categories are not eligible to participate or win the prize(s) offered: (a) Founders, employees or agents of EatArt Association or any participating advertising and promotion agencies, application development partner companies, sponsors and prize suppliers; (b) immediate family members (defined as parents, children, siblings and spouse, regardless of where they reside) and/or those living in the same household as the founders, employees or agents of EatArt Association and the members of the Jury and the Committee. The Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited.

Agreement to Official Rules: Participation in this Contest constitutes entrant's full and unconditional agreement to these Official Rules, which are final and binding in all matters related to this Contest. Winning a prize is contingent upon fulfilling all requirements set forth herein.
Submission Phase: the Submission Phase begins on October 12, 2011 at 12:00 a.m. Eastern Time ("ET"), ends on April 15, 2012 at 08:00 p.m. ET.
How to Enter: during the Submission Phase, visit http://www.imafestival.com, follow the links and instructions to register for the Contest, complete the contest registration form in English. Create an art piece on the combined theme of Food and Migration that can be entered in one of the four categories and submit your work after reading the following Submission Guidelines for each category (Submission). You may enter two (2) Submissions for each category, so long as each Submission meets all requirements. Each Submission should be original, creative, and appeal to a worldwide audience. By uploading your Submission, you agree that your Submission conforms to the Submission Guidelines and Content Restrictions defined below (collectively, the "Guidelines and Restrictions") and that Administrator, in its sole discretion, may remove your Submission and disqualify you from the Contest if it believes, in its sole discretion, that your Submission fails to conform to the Guidelines and Restrictions. Only original submissions that are personally created will be eligible to win. Submission guidelines:
For All Submissions: Limit: Entrant must have permission from all individuals that appear in the Submission to use their name and likeness in the Submission and to grant the rights set forth herein. If requested by Administrator, entrant must be able to provide such permissions in a form acceptable to Administrator. Released Parties (as defined in Section 9, below) are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Submissions; all of which will be void. All Submissions will not be acknowledged or returned. In the event of a dispute as to any Submission, the authorized account holder, at time of entry, of the email address used to register for the Contest will be deemed to be the entrant and must comply with these Official Rules. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. The entrant may be required to show proof of being the authorized account holder.
Other than what is set forth below, we are not claiming any ownership rights to your entry. However, by entering a Submission in this Contest, you agree under your full responsability to:
Finalists and Winners Determination: Finalists and Winners will be determined as set forth below.
Event and Winners Determination: the Finalists' art pieces will be showcased in an Event whose date and location will be announced on the IMAFestival website.
The finalists' art pieces will be shipped to the Administrator in formats and within the dates decided by the Administrator itself. All shipment and travel expenses of the finalists' Submissions are to be paid by the Finalists themselves, as well as any other cost associated to currency exchange.
The Administrator is not responsible for the loss or for any damage occurred at the abovementioned Finalists' art pieces.
During the aforementioned Event the Jury chosen by the Administrator will select in its sole discretion one (1) winner for each category based on the Judging Criteria: Creativity, Concept, Appealing to a worldwide audience and Adherence to the theme of Food and Migration.
Another public vote, following the same Voting Rules, will be opened on the IMAF website for the determination of the winner of the Audience Award to be chosen among the forty (40) Finalists. The online votes will be summed to the votes of the public present at the Event. The winner of the Audience Award can coincide or not with one of the winners chosen by the panel of judges.
Prizes: The Winners in each category will be awarded with the opportunity to showcase their Submission (such as but not limited to an exhibition for the visual arts works, national distribution for the music tracks, a screening or broadcasting of the films and the publishing of the literary works). Such prizes will be described in details on the IMAF Website before the 31st of January 2012. By entering this Contest, the entrants give their authorization to Administrator to include their Submissions in the offered prizes and in a catalogue that will be distributed during and after the abovementioned Event. Prizes are non-transferable and no substitution or cash redemption will be permitted unless Administrator, in its sole discretion, determines otherwise. Any other expenses associated with travels and shipping of the Finalists’ Submissions not specified herein are the sole responsibility of the Finalists. All costs associated with currency exchange are the sole responsibility of the Finalists.
Release: By participating, entrant agrees to release and hold harmless the Administrator and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers, and each of their respective parent companies and each such company's officers, directors, employees and agents (collectively, the "Released Parties") from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Contest or receipt or use or misuse of any prize.
Warranty and Indemnity: Each entrant certifies that their entry is original and that they are the sole and exclusive owner and right holder of the Submission, and that they have the right to enter the Submission in the Contest. Each entrant agrees not to entry any Submission that (1) infringes any 3rd party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (2) otherwise violates applicable law in any countries in the world. To the maximum extent permitted by law, each entrant indemnifies and agrees to keep indemnified the Administrator, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, claims, demands, losses, damages, costs and expenses resulting from any act, default or omission of the participant and/or a breach of any warranty set forth herein. To the maximum extent permitted by law, each participant indemnifies and agrees to keep indemnified the Administrator, its parent, subsidiaries, agents, directors, officers, employees, representatives and assigns harmless at all times from and against any liability, actions, claims, demands, losses, damages, costs and expenses for or in respect of which the Administrator will or may become liable by reason of or related or incidental to any act, default or omission by a participant under these Official Rules including without limitation resulting from or in relation to any breach, non-observance, act or omission whether negligent or otherwise, pursuant to these official rules by a participant.
General Conditions: Administrator reserves the right to cancel, suspend and/or modify the Contest, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Contest, as determined by Administrator in its sole discretion. If terminated Administrator may, in its sole discretion, determine the winners from among all non-suspect, eligible Submissions received up to time of such action using the judging procedure outlined above. Administrator, in its sole discretion, reserves the right to disqualify any individual it finds to be tampering with the Submission process or the operation of the Contest or to be acting in violation of these Official Rules or those of any other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Administrator reserves the right to seek damages and other remedies (including attorneys' fees) from any such person to the fullest extent permitted by law. Administrator's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
Limitations of Liability: Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrant, printing, typographical or other errors or by any of the equipment or programming associated with or utilized in the Contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer, network or human error which may occur in the administration of the Contest, the uploading, the processing or judging of Submissions or votes or the tabulating of votes, the announcement of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or (6) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released Parties are not responsible for misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer systems, servers, providers, hardware/software, lost or unavailable network connections or failed, incomplete, garbled or delayed computer transmission or any combination thereof. Released Parties are not responsible for any unauthorized third party use of any Submission.
No recourse to Judicial or Other Procedures: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to make any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded, and any participant expressly waives any and all such rights. Participants agree that these Official Rules are governed by under the provisions of American Arbitration Association.
Entrant's Personal Information: Entrants agree that personal data, especially name and address, may be processed, stored and otherwise used for the purposes and within the context of the Contest and any other purposes outlined in these Official Rules. The data may also be used by the Administrator in order to check participants' identity, their postal address and telephone number, or to otherwise verify their eligibility to participate in the Contest and to receive any prize. Entrants have a right to access, review, rectify or cancel any personal data held by the Administrator by writing to Administrator at the address stated in 3. If participant's data is not provided or is canceled, entrants’ Submissions will be ineligible.
Severability: If any provision(s) of these Official Rules are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.
Official Rules' changes or integrations: the Administrator has the right to make changes and integrations to these Official Rules only in case of organizational and/or functional needs. Moreover the Administrator has the right to make changes and integrations to the Official Rules for unexpected and unforeseen events that can undermine the artistic level of the Contest without altering the mission and the description of carrying out of Contest itself.
